Regards sur le Differend Maritime Khmero-Thaïlandais A la Lumiere de la Jurisprudence Internationale

La souveraineté territoriale constitue un problème très sensible. Aucun pays n’accepte de céder un pouce de son territoire. C’est pour cette raison que les conflits maritimes existent depuis des siècles. Ainsi, un débat sur le droit des mers se livra dès le début du XVIIième siècle, sur le plan théorique et philosophique, entre le juriste Anglais SELDEN (1584-1654), qui cherchait à âprement défendre la conception de Mare Clausum (1635), - la mer réservée à l’État le plus puissant -, conception qui ne repose pas sur le droit ou sur un traité mais sur la force, et le Hollandais GROTIUS (1583-1645), défendeur du principe de la liberté des mers, Mare Liberum (1609). GROTIUS notait que la seule découverte sans ni possession ni occupation ne relevait pas du titre de propriété. Il constatait que :
